FULL TERMS

GENERAL

These terms and conditions apply to agreements for the delivery of products and services, also referred to as goods or the goods, to end customers in Norway.

PARTS

Seller is: Digital Trend AS; Remmo 11, 5911 Alversund. Phone 991 05 039, e-mail ronny.bruknapp@newbaseline.no. Organization number 925 626 937, and is hereinafter referred to as “New Baseline”, “we” or “us”.

Buyer is: The person named as the buyer in the order regardless of the sales channel, and is hereinafter referred to as “you”, “you”, “your”, “yours” or “the customer”. The person must be at least 18 years of age to become a customer of New Baseline’s products.

SUBSCRIPTION

By becoming a New Baseline customer, you can create an ongoing subscription, but the subscription is completely free of commitment and there is no mandatory contract period.

If you do not inform us within 30 days before the next delivery is sent that you want to stop your subscription, you will continue to receive deliveries every four months until you cancel the agreement.

As mentioned, the subscription is ongoing and you are free to make changes – such as pausing for a specific time, accelerating deliveries or unsubscribing.

PRICES

Our prices are stated in Norwegian kroner and include VAT. The price of the product may vary depending on the channel, distribution and special promotions. Prices are valid until changed. Notification of price changes will be sent in good time before the changes come into force; no later than 1 month before the change.

Unless otherwise agreed, postage and handling charges will be added to each shipment in accordance with applicable rates.

CUSTOMER SERVICE

Our customer service can be contacted by phone on 991 05 039, Monday to Friday between 7:00 a.m. and 8:00 p.m. 09.00 and 16.00.

PAYMENT

Payment is made via invoice or by card. The invoice is sent together with the delivery to the buyer of the goods. Payment terms are stated on the invoice.

DELIVERY

We only deliver parcels within Norway. Your order will arrive in your mailbox between 5-7 days after we have received your order. You will then receive new shipments according to the agreed delivery frequency. In the case of special offers, larger or multiple orders, the item may need to be collected from the post office due to size and weight. In the event of a change of address, you are obliged to inform us of your new address.

PERSONAL DATA

We process all personal data in accordance with the Personal Data Act. We store and use this information in order to manage and administer the customer relationship, including providing information about products, services and other benefits from Digital Trend AS. The customer agrees that Digital Trend AS may use any form of communication with you, including letter, telephone, e-mail and SMS to inform about or market our product offerings. ANGRERETT

As a customer, you are protected by the Cancellation Act and have a 14-day unconditional right of withdrawal from the day you receive the item on your first shipment (also called a trial package or starter pack). The right of withdrawal means that you have the right to cancel the purchase of an unopened product and return the item to us. In order for the right of withdrawal to be exercised, the product must have been delivered to us in the same quantity and condition as when you received it. In the event of a return, you are responsible for return costs. We have an extended return policy of 30 days.

RETURN POLICY FOR GOODS IN SUBSCRIPTIONS

You can only return the first delivery you receive from us (also known as a trial package or starter kit). The next items are identical to the first item and therefore there is no right of return on the shipments you receive after the first delivery. We must receive information from you no later than 30 days before the next delivery is sent (the date of the next delivery appears on the invoice) if you want to cancel your subscription and for us to be able to stop the delivery.

We do not credit invoices for deliveries sent back to us. If you want us to resend it, you will be charged a fee of SEK 99. This is to cover our costs in connection with the handling of returns and postage/forwarding in connection with the shipment.

ADVERTISING

A full right of complaint is granted in accordance with applicable laws for all defects in the goods.

The right of complaint is limited to the product’s expiry date as stated on the packaging, provided that proper storage has been followed and a maximum of two months from the time the matter complained about was discovered. In any event, the buyer is obliged to make a complaint within a reasonable time after the defect is discovered. In the event of a complaint, fault or defect, you will be reimbursed for any shipping costs. CONFLICT RESOLUTION

Complaints should be directed to us within a reasonable time, cf. the point about complaints. The parties shall attempt to resolve any disputes amicably. If this is unsuccessful, the buyer can contact the Consumer Council for mediation. The Consumer Council is available by phone at 23 400 500 or www.forbrukerradet.no

CHOICE OF LAW AND JURISDICTION

The agreement is governed by Norwegian law. Disputes between the parties shall be resolved through negotiations. If negotiations are unsuccessful, the dispute shall be referred to the ordinary courts

RESERVATIONS AND LIMITATIONS OF LIABILITY

Digital Trend reserves the right to transfer its rights and obligations under this Agreement to another party.

Digital Trend is not liable for downtime, incorrect prices or delivery problems due to circumstances beyond its control.

Digital Trend also reserves the right to make printing errors, pricing errors, value added tax and other tax changes. Any offers are valid while stocks last.

Digital Trend does not take responsibility for incorrect use of the item. Follow the recommended dosage.

CHANGE OF TERMS AND CONDITIONS

The terms and conditions are subject to change in the event of special needs and/or government changes or orders affecting these terms and conditions. You will be notified of any changes to the terms and conditions. Such notice is given up to 1 month before the changes come into force. If, based on the changed terms and conditions, you wish to terminate the agreement, you are free to do so. If the agreement between the parties is not terminated, this means that you accept the updated terms and conditions. New terms will be announced on our website or in combination with the dispatch of the item(s).
